Terms and Conditions of Training

Please read this agreement carefully before accessing or using the information and services available through the Training Aid Australia.edu.au website (“Site”). By accessing or using the Site, I acknowledge and agree to abide by the terms and conditions below.

Modifications

Training Aid Australia may modify this agreement at any time, and such modifications shall be effective immediately upon placement of the modified agreement on the Site.

Language, Literacy and Numeracy

Students who have difficulty with basic literacy, numeracy, English language or other areas of learning are requested to advise us of this at the time of enrolment. Third party institutions may be able to provide direct assistance or refer the student to the appropriate agency.

Interpreter/Translator Policy

Some training courses (please refer to particular course requirements) allow the use of interpreters and translators.

For those participants whom require the use of an interpreter or translator please be aware that the following conditions must be abided by:

If a participant is to bring a family member, colleague or friend to act an interpreter or translator, the translator must be a full paying (non-prepaid price) participant and NOT hold a valid certificate or qualification in the course to be completed by the participant who requires the translation. The translator must also be deemed competent at the completion of the course. The translator must reserve a seat in the same manner as the participant whether that be via phone or via the booking form contained on the training organisations website.

If a participant is to require the use of an official translation service, the translator will be sourced by the training organisation to maintain independence. When a training organisation is required to source a translator, the participant must notify the training organisation a minimum of 48 business hours prior to the course commencing. This will be sourced at the participant’s expense. The translator must produce sufficient documents to the training organisation upon arrival to verify their credentials. The translator must be booked and paid for a minimum of 48 business hours prior to the course commencing.

Copyright in photographs and right to use

I acknowledge and consent to photographs being taken of me during my participation in the Training Aid Australia Course. I acknowledge that the photographs are owned by Training Aid Australia and that Training Aid Australia may use the photographs for promotional or other purposes without my further consent being obtained. Further, I consent to the Training Aid Australia Course organisers using my name, image, likeness and also my performance in the Training Aid Australia Course, at any time, to promote the Training Aid Australia Course by any form of media.

Course Price

Training Aid Australia Pty Ltd reserves the right to change course price at any time without notice and such change shall be effective immediately upon posting the new price.

Prepaid Special Terms

The prepaid special discounted price is only applicable to prepayments (i.e. payments made before the scheduled date of training) made via the website or telephone bookings with a credit card or cash payments made in person.

Please note that the prepaid special discounted price does NOT apply to the invoice payment method.

Invoice Payment Method Terms

The prepaid special discounted price does NOT apply to the invoice payment method. When this method of payment is used, the full price applies.

For an invoice to be valid and issued, a Purchase Order (PO) must be submitted prior to the date of training.

PO must include 1) Participant’s name 2) Course and date of training 3) Company details (company name, address, ABN) 4) Contact details.

Invoices will only be issued after training has been completed (as long as the proper procedure has been observed).

Online Payments

Payments made via the website are facilitated by PayPal payment gateway.

Cancellation, Transfer and refund policy

If you are late to a training session Training Aid Australia reserves the right to refuse entry to a course. Training Aid Australia will assist in re-booking a training session, however additional fees apply.  For full policy, see Transfer and Refund Policy.

Training Aid Australia makes every effort to keep the availability listed on the website as accurate as possible. However, in any instance where a course is cancelled, or fills up, outside of normal working hours (Monday- Friday 8:30am-5:00pm), the administrative team will contact you as soon as possible on the next working day to transfer your enrolment or refund your fees, less bank fees and an admin processing fee.

All requests for refunds must be received in writing or via email to enrolments@trainingaid.com.au.  Refund requests will be reviewed and processed within 5 business days of receiving the confirmation of refund.  All refunds will incur a $10 administrative fee.

Privacy

Training Aid Australia is committed to protecting client privacy and confidentiality in line with State and Federal Privacy legislation. This policy focuses on Training Aid Australia’s commitment to protecting the privacy of its students and outlines the various ways in which it ensures this protection.

Training Aid Australia uses personal information of its students for the purposes of meeting VET requirements for the awarding of national qualifications, and to comply with reporting requirements where relevant, as specified by government regulators.

Personal information is collected through the enrolment form or through other means will be passed on to government regulators as per legal data collection requirements. This personal information may also be accessed for the purposes of an audit by the ASQA.

Personal information will not be used in any way other than those outlined in this policy, and any other ways that might reasonably be expected.

Security Policy

When purchasing from Training Aid Australia your financial details are passed through a secure server using the latest 128-bit SSL (secure sockets layer) encryption technology. 128-bit SSL encryption is the Australian financial industry standard. We strive for the information provided on this website to be as accurate and true as possible at the time of publication. You agree that any content viewed, downloaded or otherwise obtained through the use of the service is done so at your own discretion and risk.

Email Disclaimer

The information in the electronic mail messages sent from enrolments@trainingaid.com.au domain is confidential and intended only for the use of the addressee named in the email. Access to that message by anyone else is unauthorised. If you are not the intended recipient, please delete this mail message and kindly notify Training Aid Australia at enrolments@trainingaid.com.au or by phone 1300 663 350. Any disclosure, copying, distribution or any other action taken or omitted to be taken in reliance on it is prohibited and may be unlawful. Training Aid Australia accepts no responsibility for any effects this mail message or attachments have on the recipients’ network or computer systems.

Participation in the Training Aid Australia Course can be inherently dangerous

Serious accidents may happen which may result in me being injured or even killed. I have voluntarily read and understood this warning and accept and assume the inherent risks in the Training Aid Australia Course.

Exclusion of liability

Except where provided or required by law and such cannot be excluded, I agree that it is a term of my entry in the Training Aid Australia Course (if accepted) that Training Aid Australia is absolved from all liability however arising from injury or damage however caused (whether fatal or otherwise) arising out of my participation in the Training Aid Australia Course.  I acknowledge that the services and benefits I receive in relation to the Training Aid Australia course are “recreational services” as defined under the Trade Practices Act 1974. Where I am a consumer, as defined by any relevant law, certain terms and rights may be implied into a contract for the supply of goods or services for my benefit. I acknowledge that these terms and rights, and any liability of Training Aid Australia flowing from them, are expressly excluded, restricted or modified by these Training Aid Australia course terms and conditions.

Insurance

Insurance is in place that provides limited cover to me whilst I am participating in the Training Aid Australia course.  I understand that this insurance may not cover me for any injury, loss or damage sustained by me and I can, in my own interests, seek and obtain personal insurances over and above the cover provided by Training Aid Australia.

Release and Indemnity

In consideration of Training Aid Australia accepting my application for entry to the Training Aid Australia course, I:

  1. release and forever discharge Training Aid Australia from all claims that I may have or may have had but for this release arising from or in connection with my participation in the Training Aid Australia course; and
  2. indemnify and hold harmless any action, liability, claim, loss damage, proceeding, expense (including legal costs) incurred or suffered by us, arising from, or which is directly or indirectly related to:
    • your breach or failure to observe any of these Terms;
    • any breach or inaccuracy of any of your representations or warranties; and
    • your use of any part of the Website

Training Aid Australia to the extent permitted by law in respect of any claim by any person including by not only another participant in the Training Aid Australia course arising as a result of or in connection with my participation in the Training Aid Australia course.

“Claims” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising but does not include a claim in respect of any action, suit, etc made by any person entitled to make a claim under a relevant Training Aid Australia insurance policy.

Fitness to participate

I declare that I am and must continue to be medically and physically fit and able to participate in the Training Aid Australia course.  I am not and must not be a danger to myself or to the health and safety of others. I will immediately notify Training Aid Australia in writing of any change to my fitness and ability to participate. I understand and accept that Training Aid Australia will continue to rely upon this declaration as evidence of my fitness and ability to participate.

Medical treatment

I consent to receiving any medical treatment that the Training Aid Australia course organisers or their authorised representatives consider necessary or desirable during or after the Training Aid Australia course.  I also agree to reimburse Training Aid Australia for any costs or expenses incurred in providing me with medical treatment.

Marketing

I consent to receiving marketing and promotional material as well as information relating to the industry.  Training Aid Australia may send you job opportunities, newsletters, updates as well as offers for discounts on training courses.  This material can (but not limited to) emails, text messages as well as various other distributions. Training Aid Australia will ensure that the information is relevant, and it is not our intention to send spam emails. You will always have the option to unsubscribe to any mailing or distribution list.  If you do not consent to receiving this information, please request to be taken off or not added to any mailing list in writing to enrolments@trainingaid.com.au.

This declaration constitutes a contract

Between myself and Training Aid Australia Pty Ltd.
